Overview

 

Kevin Jacobs is a commercial litigator with more than 25 years of experience serving as lead counsel for publicly traded companies, financial institutions, and private equity-backed businesses in their most consequential disputes. His practice spans bet-the-company commercial litigation, securities and corporate governance matters, intellectual property and trade secret disputes, and the internal and government investigations that often accompany them. He has secured favorable outcomes in matters valued in the hundreds of millions of dollars, and has represented clients in inquiries and enforcement actions before the SEC, DOJ, FTC, FINRA, the U.S. Department of Education, and state attorneys general.

Before entering private practice, Kevin served as an intelligence analyst in the U.S. Army Military Intelligence Corps — work that shaped a litigation style built on careful preparation and reading a matter several moves ahead.

Among his recent representative matters is the defense of ARC Global Investments II LLC in the Trump Media & Technology Group Corp. litigation. A name partner of Homer Bonner Jacobs Ortiz & Dimond, Kevin is known for telling clients plainly which fights are worth having and which are not.

Representative Experience

 


  • Represented ARC Global Investments II LLC, the SPAC sponsor, in the high-profile Trump Media & Technology Group Corp. litigation, including defeating a preliminary injunction that sought to bar the sponsor from receiving or selling its shares.
  • Secured an approximately $15 million arbitration award, on an expedited schedule, for a government workforce solutions company.
  • Enforced a twenty-year-old indemnity provision in a purchase and sale agreement, securing complete indemnification for legacy asbestos-related claims for a publicly traded shipping conglomerate.
  • Won dismissal of software trade-secret claims against a publicly traded company and its subsidiary by proving the plaintiff had committed fraud on the court.
  • Obtained a permanent end to a competitor’s use of an infringing mark through a trademark counterclaim brought for a publicly traded education company.
